Is it legal to hold a YAP congress in a special quarantine regime?

The ruling New Azerbaijan Party (YAP) held its seventh congress on March 5.

Despite the restrictions imposed under the special quarantine regime, the congress took place at the party's headquarters, not online. The party's chairman, President Ilham Aliyev, and first deputy chairman, Mehriban Aliyeva, attended the congress in a video conference. However, other participants of the congress gathered at the party's headquarters and a large number of people attended the event.

Fakt Yoxla analyzed whether the YAP's live congress contradicted the restrictions imposed under the special quarantine regime.

A special quarantine regime has been applied in Azerbaijan since March 24, 2020.

The latest decision of the Cabinet of Ministers announced that the special quarantine regime has been extended until April 1, 2021.

The rules of the Operational Headquarters regarding the restrictions applied in the special quarantine regime state that it is prohibited to hold all public events in the country and for individuals to gather in groups of more than 10 people.

The Baku City Executive Power rejected the request of the Republican Alternative (ReAl) Party to hold a founding conference on June 17, 2020, citing the existence of a quarantine regime in the country.

Fakt Yoxla concludes that the congress held by the ruling party at its headquarters under a special quarantine regime contradicts the restrictions adopted by the Cabinet of Ministers, and holding such a congress is a violation of the law.
